Do Wills Have to Be Notarized?

When writing a will, many people wonder if it needs to be notarized to be legally valid. While it may seem like notarization is essential, the truth is that it is not required in most states. Only a few states have such a requirement, and even in those cases, notarization is not necessary for the will to be valid.

In Texas, for example, you are not required to have your will notarized. Here's the key point: the most important aspect of making a will legally binding is having witnesses. In Texas and most other states, a will must be signed by the testator (the person creating the will) in front of at least two witnesses, who must also sign it. These witnesses attest that the testator is of sound mind and is voluntarily signing the will. Without these witnesses, the will may be challenged in court later.

However, many people choose to have their wills notarized for added peace of mind. Notarization can further prove the will's authenticity. In some instances, a self-proving will—which includes a notarized affidavit from the testator and witnesses—can streamline the probate process. In such cases, the court may not need to call witnesses to verify the will's legitimacy, which can save time and legal fees.

Interestingly, a 2022 study found that nearly 67% of Americans do not have a will in place. Among those who do, many overlook important details like notarization, which can lead to unnecessary delays in probate. Ensuring that your will is properly executed can prevent costly mistakes and clarify your wishes to loved ones.

In summary, while notarization is not required for most wills, having your will properly witnessed and notarized can significantly enhance peace of mind for you and your family. Contact us today if you require your will to be notarized!
